{"id":354,"date":"2024-02-06T11:10:44","date_gmt":"2024-02-06T10:10:44","guid":{"rendered":"https:\/\/www.up2rent.com\/blog\/hello-world\/"},"modified":"2024-06-13T11:24:58","modified_gmt":"2024-06-13T10:24:58","slug":"ordonnance-bail-bailleur-bruxellois","status":"publish","type":"post","link":"https:\/\/www.up2rent.com\/fr\/blog\/ordonnance-bail-bailleur-bruxellois\/","title":{"rendered":"Ce qui change pour les bailleurs bruxellois avec la nouvelle ordonnance bail"},"content":{"rendered":"\n<p><strong>Cette nouvelle ordonnance port\u00e9e sur les fonds baptismaux par la secr\u00e9taire d\u2019Etat au Logement Nawal Ben Hamou (PS) et approuv\u00e9e par le Parlement bruxellois en mars 2024, augmente les contraintes impos\u00e9es aux propri\u00e9taires bailleurs.&nbsp;<\/strong><\/p>\n\n\n\n<p>Cette ordonnance vise \u00e0 faciliter l\u2019acc\u00e8s du locataire \u00e0 un logement d\u00e9cent, abordable et \u00e0 lutter contre les expulsions ill\u00e9gales. En pratique, les bailleurs devront jongler avec une s\u00e9rie de contraintes nouvelles en R\u00e9gion de Bruxelles-capitale :<\/p>\n\n\n\n<p>La <strong>garantie locative<\/strong> s\u2019\u00e9l\u00e8vera \u00e0 <strong>deux mois<\/strong> de loyer au maximum, obligatoirement d\u00e9pos\u00e9s sur un compte bancaire.&nbsp; A la sortie du bail, le propri\u00e9taire aura deux mois au maximum pour la restituer au locataire, sous peine d\u2019une somme \u00e0 verser au locataire.<br>L\u2019<strong>augmentation du loyer<\/strong> se trouve encadr\u00e9e en pratique par la nouvelle ordonnance : le propri\u00e9taire perd la libert\u00e9 d\u2019augmenter un loyer entre deux locataires. L\u2019indexation reste possible.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><\/p>\n<cite>Up2Rent fait ce calcul automatiquement en temps voulu pour tous les baux. Les propri\u00e9taires choisissent ensuite, ou non, d\u2019appliquer l\u2019indexation et de la communiquer aux locataires par une communication automatique et\/ou personnalis\u00e9e..\u00a0<\/cite><\/blockquote>\n\n\n\n<p>Le <strong>d\u00e9compte de charges<\/strong> est aussi vis\u00e9 par cette nouvelle ordonnance. Toute erreur dans le d\u00e9compte de charges pourra \u00eatre rectifi\u00e9e. Seulement, quand l\u2019erreur est \u00e0 charge du propri\u00e9taire, le locataire peut r\u00e9clamer la rectification sur l\u2019ensemble des p\u00e9riodes. Quand l\u2019erreur est \u00e0 charge du locataire, le propri\u00e9taire peut r\u00e9clamer la rectification au maximum sur cinq p\u00e9riodes annuelles. Pour les deux, locataire et bailleur, la rectification doit avoir lieu dans les deux ans de l\u2019\u00e9tablissement du d\u00e9compte.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><\/p>\n<cite>Ici aussi, Up2Rent facilite la vie des bailleurs ou de leurs gestionnaires qui font face \u00e0 un certain nombre de d\u00e9comptes de charges : l\u2019application les calcule automatiquement en fonction des relev\u00e9s des compteurs, par unit\u00e9 locative et par propri\u00e9t\u00e9. Les d\u00e9comptes sont \u00e9tablis en toute transparence pour toutes les parties.<\/cite><\/blockquote>\n\n\n\n<p>Enfin, le bailleur ne peut en principe plus refuser un locataire \u00e0 cause de son <strong>animal domestique<\/strong>. Les baux de courte dur\u00e9e pourraient \u00eatre prolong\u00e9s une fois seulement.&nbsp;&nbsp;<\/p>\n\n\n\n<p>L\u2019impact imm\u00e9diat des nouvelles mesures est une complexit\u00e9 \u00e0 laquelle les bailleurs doivent faire face, en jonglant \u00e9galement avec l\u2019introduction r\u00e9cente du droit de pr\u00e9f\u00e9rence.
