Il se peut que vous souhaitiez concentrer votre activit\u00e9 sur une r\u00e9gion ou certains immeubles, d\u00e9gager des liquidit\u00e9s pour, par exemple, le r\u00e8glement de droits de succession, ou, simplement, que vous remarquiez que certaines de vos unit\u00e9s sont, de mani\u00e8re durable, parmi les moins efficaces de votre portefeuille. Ainsi, vendre une unit\u00e9 locative n\u2019interrompt jamais le bail relatif \u00e0 cette unit\u00e9. Simplement, l\u2019acqu\u00e9reur devient le bailleur du locataire de l\u2019unit\u00e9 vendue.\u00a0<br>A Bruxelles depuis janvier 2024, ces droits comprennent aussi <strong>une forme de droit de pr\u00e9emption pour le locataire, le droit de pr\u00e9f\u00e9rence<\/strong>.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Champ d\u2019application du droit de pr\u00e9f\u00e9rence du locataire bruxellois<\/h2>\n\n\n\n<p>Le droit de pr\u00e9f\u00e9rence s\u2019applique aux locataires, \u00e0 certaines conditions :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le droit de pr\u00e9f\u00e9rence concerne uniquement les baux de r\u00e9sidence principale conclus pour neuf ans (ou plus).<br><\/li>\n\n\n\n<li>Il vise le locataire qui doit y \u00eatre domicili\u00e9, son cohabitant l\u00e9gal ou de fait, ses enfants, du moment que tous y soient domicili\u00e9s, ainsi que des colocataires, \u00e9tudiants. La condition est la <strong>domiciliation<\/strong>.<br><\/li>\n\n\n\n<li>Le droit de pr\u00e9f\u00e9rence s\u2019applique aussi dans le cas des ventes publiques.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Le droit de pr\u00e9f\u00e9rence ne s\u2019applique pas aux locataires avec des baux de courte dur\u00e9e ou lors de ventes entre membres de la m\u00eame famille.<\/p>\n\n\n\n<p>A un niveau purement pratique, l\u2019entr\u00e9e en vigueur de ce droit de pr\u00e9emption impose un certain calendrier au propri\u00e9taire qui souhaite vendre.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Proc\u00e9dure \u00e0 respecter par le propri\u00e9taire bailleur en cas de vente \u00e0 Bruxelles en 2024<\/h2>\n\n\n\n<p>Voici un zoom sur la marche \u00e0 suivre en cas de vente et les d\u00e9lais qui s\u2019imposent d\u00e9sormais aux propri\u00e9taires.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le propri\u00e9taire doit Informer le locataire de la vente par recommand\u00e9 avec accus\u00e9. Le courrier doit reprendre la description du logement, le prix et les conditions de vente. Cela vaut offre non-n\u00e9gociable au locataire en termes de prix et de conditions.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Au terme de ces 30 jours seulement, le propri\u00e9taire peut mettre le bien sur le march\u00e9 de mani\u00e8re classique.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Si le bien est c\u00e9d\u00e9 \u00e0 un prix inf\u00e9rieur, le locataire doit en \u00eatre inform\u00e9. Il dispose alors de sept jours suppl\u00e9mentaires pour exercer son droit de pr\u00e9f\u00e9rence.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Ces diff\u00e9rentes \u00e9tapes ralentissent la vente, ce qui peut \u00eatre tr\u00e8s g\u00eanant pour le propri\u00e9taire qui doit \u00e9ventuellement faire face \u00e0 d\u2019autres obligations.<\/p>\n\n\n\n<p>Le propri\u00e9taire qui ne respecte pas cette proc\u00e9dure s\u2019expose \u00e0 des sanctions : le locataire qui aurait \u00e9t\u00e9 l\u00e9s\u00e9 peut intenter une action de justice en subrogation contre l\u2019acqu\u00e9reur &#8211; qui n\u2019a, lui, eu aucune responsabilit\u00e9 dans le processus.
